Landlord FAQs

Electrical safety rules for landlords: common questions

These answers summarise the rules for private rented homes in England. They are general information, not legal advice.

How often does a rented property need an EICR in England?

Under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020, landlords must have the electrical installation inspected and tested by a qualified and competent person at least every five years. If the report recommends an earlier date, the next inspection must happen by that date.

Who needs a copy of the EICR, and by when?

Landlords must give a copy of the report to existing tenants within 28 days of the inspection, to new tenants before they occupy the property, and to prospective tenants within 28 days of a request. The local housing authority can request a copy, which must be supplied within 7 days. Landlords should also keep a copy to give to the inspector carrying out the next inspection.

What happens if the EICR is unsatisfactory?

A report is unsatisfactory if it records a C1 (danger present), C2 (potentially dangerous) or FI (further investigation required) observation. The landlord must arrange for the remedial work or further investigation to be carried out within 28 days, or within any shorter period stated in the report, and obtain written confirmation that the work has been completed. That confirmation, with the report, must be given to the tenant and the local authority within 28 days of the work being completed.

Does a C3 code mean the property fails?

No. C3 means improvement recommended. It does not on its own make the report unsatisfactory, although it is worth considering, especially when planning other work.

Do the regulations apply to HMOs?

Yes. The 2020 regulations apply to most private tenancies in England, including houses in multiple occupation (HMOs).

What are the penalties for not complying?

Local authorities can take enforcement action against landlords who breach the regulations, including issuing financial penalties of up to £30,000.

Who can carry out a landlord EICR?

The inspection must be carried out by a qualified and competent person. Government guidance suggests landlords can check that their inspector is a member of a competent person scheme. JT Electrical is NAPIT registered.

Is PAT testing a legal requirement for landlords?

The 2020 regulations cover the fixed electrical installation, not portable appliances. However, landlords must make sure any electrical appliances they provide are safe, and PAT testing is a common and practical way to show this, particularly in HMOs and furnished lets.

Professional. Reliable. Local.
